Is CBD a drug?
Cannabidiol (CBD) is one of the many cannabinoids that make up hemp, particularly Cannabis Sativa L. The substance has numerous therapeutic benefits. CBD does not cause euphoria and is not addictive. So is CBD a drug?
The properties of CBD
CBD (cannabidiol) is a chemical compound extracted from cannabis. Cannabis is considered a drug. Indeed, hemp has psychoactive properties. The euphoric effects of CBD result in particular from the actions of tetrahydrocannabinol (THC) in the body. Unlike THC, CBD has no psychotropic effect and does not produce a "high" or a state of euphoria. Cannabidiol also does not cause dependence.
In other words, CBD is not considered a drug. Indeed, the cannabinoid does not cause any alteration of consciousness or mood. Instead, it is used for its potential properties. Various specialized scientific studies demonstrate in particular its properties for relieving pain, reducing anxiety, helping to sleep, and for other therapeutic uses.
Know that the therapeutic properties of cannabidiol are recognized by the WHO. The same applies to the absence of risk of euphoria and addiction related to the use of CBD.
Is CBD legal in France?
In France, CBD regulations are complex and constantly evolving. In general, due to the absence of a narcotic effect, CBD is not considered an illegal substance. However, there are strict rules governing its use, sale, and distribution.
On 29 November 2022, the French Council of State officially announced the legalization of CBD in France. Thus, the cultivation and consumption of cannabidiol are legally authorized in France. These practices are, however, governed by specific regulations stipulating:
- the limit of the THC rate in CBD hemp extracts and in CBD products at 0,3%. Beyond this legal threshold, THC can exert its narcotic effects. Any CBD product containing more than 0,3% THC is therefore considered a drug;
- the exclusive cultivation of CBD from Cannabis Sativa L.: this variety of cultivated hemp has a relatively low THC rate. It is the only one authorized for cultivation in the European Union;
- the exclusive use of CBD for health and well-being.
Furthermore, in France, CBD-based products are considered everyday consumer products and not medicines. This means that the sale of CBD-based products is authorized in physical stores and online. However, products cannot be marketed with therapeutic claims.
In addition, CBD-based products must also be labeled with a complete list of ingredients. Buyers must also be able to find an accurate description of the CBD and THC content on product packaging. French authorities may carry out checks on CBD products to ensure their compliance with current regulations.
Are there CBD screening tests in France?
Not being a narcotic, the cannabinoid is legalized in France. Carrying out CBD screening tests is therefore of no interest to the French authorities.
However, there are tests to detect the presence of CBD in saliva and in urine. These devices are used in the context of scientific research on the effects of cannabidiol in the body.
Can you test positive on a drug screening test after consuming CBD?
In France, drug screening tests are designed to detect the presence of illegal narcotic substances. In this category of products, one can notably mention cocaine, heroin, and THC in marijuana. CBD does not belong to this family of products. Thus, drug screening tests should not give a positive result if you have taken CBD.
Nevertheless, it can happen that some CBD consumers test positive on drug tests after consuming CBD. In this case, the product in question therefore has a THC rate higher than the legal limit. The consumer therefore faces the penalties provided for drug use.
