Is CBD flower legal?

French legislation concerning the production, sale, and consumption of CBD has undergone significant developments over the years.

CBD flower in France until December 2021

Until 30 December 2021, the sale and use of CBD were governed by the decree of 22 August 1990. This law imposes a THC limit of 0,2 % in CBD products. Indeed, beyond this legal threshold, THC exerts its euphoric effects and can lead to addiction.

The decree also authorizes the exclusive exploitation of cannabis sativa L. fibers and seeds. The cultivation and use of other Cannabis varieties are prohibited within the European Union.

Changes to French law on the exploitation of CBD flower in 2022

The decree of 30 December 2021 prohibits the exploitation of cannabidiol leaves and flowers. Indeed, THC leaves and flowers are impossible to distinguish from THC leaves and flowers, which are strictly prohibited. French authorities therefore introduced this law to better control the flow of narcotics in France.

On 24 January 2022, the decree was suspended by the Council of State. During this period, the production, sale, and consumption of CBD flower are authorized in France. In addition, CBD is also said to be a sleep regulator, an antibacterial, an antifungal, and may inhibit the growth of tumors and cancers. These studies still require further research on the subject.
