Can you drive with CBD?

CBD, an acronym for Cannabidiol, is one of the main cannabinoids that make up Cannabis Sativa L.. The molecule has no euphoric effects and does not alter behavior. However, the question can you drive with CBD? remains an important issue that consumers face. Find the answers in this dedicated guide.

The specificities of CBD

The cannabis plant has been cultivated and used for several centuries for therapeutic purposes. Cannabidiol notably concentrates the many benefits of the medicinal plant. Some of its properties are demonstrated by specialized scientific studies. Research on CBD is still ongoing to support existing results and reveal other actions of the product. Due to the absence of psychotropic effects, cannabidiol is not considered a narcotic. The substance is legalized in several European countries, including France.

CBD has beneficial effects on health. Its many virtues have been widely communicated in the media in recent years. However, not enough is said about its side effects. Indeed, if it is not used properly, cannabidiol can cause undesirable consequences.

The health benefits of CBD

Scientific trials have enabled specialists to establish that the cannabidiol molecule acts as a:

  • Painkiller: CBD binds to the receptors of the endocannabinoid system to inhibit the sensation of pain;
  • Anti-inflammatory: CBD acts on the immune system by limiting the reactions of cells to external aggression. The product soothes inflammation;
  • Anti-emetic: the cannabinoid regulates the functioning of the digestive system. It notably relieves the contractions that occur in the small intestine. Thus, CBD helps fight nausea and vomiting while optimizing digestion;
  • Soothing, anti-anxiety and anti-stress: CBD stimulates the secretion of the neurotransmitters responsible for good mood and well-being. The cannabinoid also promotes the production of melatonin, the sleep hormone. The product may also have regulatory properties for the nervous system.

Scientific studies also prove that CBD could be an antiseptic. Cannabidiol would also have actions against the development of tumors and cancers. Studies are still ongoing on this subject.

The adverse effects of CBD on the body

Cannabidiol can cause undesirable side effects or reversed effects. This is generally due to a CBD overdose or an interaction with certain medications. Among the most common consequences, we can mention:

  • drowsiness and decreased concentration;
  • digestive disorders manifesting as diarrhea, constipation, nausea, or even vomiting,
  • migraines.

In addition, some consumers complain of dry mouth after consuming CBD. This discomfort is due to the actions of the molecule on the salivary glands. Drinking a large glass of water after ingesting the CBD product is enough to rehydrate the mouth.

The best way to avoid the adverse effects of CBD is to seek advice from a doctor or an expert. The specialist is best able to determine the dose that suits you for the treatment in question. He or she also has the experience and knowledge necessary to establish any harmful interactions between medications and the cannabinoid. Finally, make sure of the quality of the CBD. To do this, inquire about the origin of the product as well as its processing. Also find out about the credibility and professionalism of the merchant.

Does CBD affect driving?

CBD has calming and relaxing effects. In some cases and depending on the consumer's metabolism, the cannabinoid could cause a decrease in alertness. As a precaution, it is therefore better to avoid consuming CBD before getting behind the wheel of a vehicle. Indeed, driving requires maximum concentration. A loss of alertness, even minimal, can expose the driver to the risk of accidents.

Likewise, it is absolutely inadvisable to drive machinery or handle a machine, device, or work tool after taking cannabidiol.

Can you test positive for CBD in the event of a roadside check?

The saliva drug screening test carried out by law enforcement on the roads detects narcotic products. Having no psychotropic effects, the cannabidiol molecule is not detectable by drug tests.

However, the drug screening test can provide a positive result. This situation mainly occurs if the product contains THC. In accordance with the highway code and the legal provisions concerning alcohol or drugs while driving, the consumer faces a fine of up to 4 500 Euros as well as a prison sentence of 2 years. These penalties may be accompanied by a deduction of 6 points from the driving license.

If you test positive following CBD consumption, ask the officer to carry out another, more in-depth test to prove your innocence.

Is CBD legal in France?

The law governing the exploitation and use of CBD in France has undergone several modifications over the years. However, the announcement by the Council of State on 29 December 2022 formalizes the legalization of CBD in France. The French authorities thus join the governments of several European countries on the question of authorizing CBD. Thus, all CBD extracts as well as derived products are legally authorized in France.

However, French legislation sets the limit of THC content in CBD products and hemp CBD extracts at less than 0,3%. Indeed, beyond this legal threshold, THC can cause euphoria and thus alter the consumer's state of consciousness and behavior. Furthermore, only CBD extracts and derived products from Cannabis Sativa L. plants (or cultivated hemp) are authorized in the European Union. Other cannabis varieties are strictly prohibited.

How long after consuming CBD can you drive without risk?

Taking CBD does not expose the consumer to specific risks related to driving a car. However, the effects of cannabidiol can vary considerably from one individual to another, depending on metabolism. Thus, some consumers may feel the side effects even when taking a minimal dose of CBD. If this is your case, avoid driving after ingesting Cannabidiol

For information purposes, the body takes between 2 and 6 hours to completely eliminate CBD. To rule out any risk, wait 6 hours after consuming CBD before getting behind the wheel of your car.

Thus, if you have to drive a car during the day, avoid consuming cannabidiol in the morning. Instead, opt for consumption at the end of the day or in the evening, when you no longer have to drive a car.

Is it legal to transport CBD in a car?

You risk no penalties if you transport CBD in a car in France and in the EU. Be careful, however, to have your receipts on you and don't walk around with a large quantity of products that could be mistaken for black market resale.

Can you bring CBD in a car in France and the EU?

The Court of Justice of the European Union on 19 November 2020 issued a precise decision regarding the transport of CBD in a car. This announcement came in the context of the handling of the "Kanavape" legal case. It therefore indicates that the transport of CBD by car or by other means is authorized in France and in the member states of the European Union. This law concerns legal CBD with a THC level below 0,3% and originating from Cannabis Sativa L. You can therefore drive on European roads with hemp CBD extracts (seeds, flowers, leaves) and CBD products (oil, resin, infusions, e-liquid, candies, food products, etc.) in your car.

Nevertheless, to avoid any mishap while transporting CBD in a car on French and European roads, take a few precautions. In particular, make sure to package the product well. Furthermore, if possible, request a certificate from the merchant indicating the THC level present in the product.

Is it permitted to transport CBD medications in a car in France and the EU?

The provisions are different for CBD medications. Indeed, certain hemp CBD medications may display a THC content higher than the legal limit. In France, certain CBD medications are authorized even with a high THC level. This is notably the case for certain medications intended for the treatment of multiple sclerosis and epilepsy. Patients who have a prescription established by their attending physician can transport these products in a car. However, we advise against taking these medications in a car outside French borders and even on European roads. The laws are indeed not the same in all EU countries.

The provisions relating to CBD are constantly undergoing significant developments. It is advisable to stay alert to the news about CBD. Closely follow current events in France and within the European Union concerning cannabis. This will prevent you from falling into illegality regarding the use and transport of hemp CBD extracts and Cannabidiol products.
